《汕头市行政执法监督条例》已由汕头市第十二届人民代表大会常务委员会第十次会议于2008年4月23日通过,2008年7月31日广东省第十一届人民代表大会常务委员会第四次会议批准,现予公布,自2008年10月1日起施行。

第一条 为了建立和完善行政执法层级监督机制,加强对行政执法行为的监督,防止和纠正违法或者不当的行政执法行为,保护公民、法人和其他组织的合法权益,全面推进依法行政,根据有关法律、法规的规定,结合本市实际,制定本条例。
第二条 本市行政区域内市、区(县)人民政府对所属行政执法机关和下级人民政府,市人民政府所属行政执法机关对本系统下级行政执法机关或者受其委托的执法单位行政执法行为的监督,适用本条例。
对法律、法规授权的具有管理公共事务职能的组织行政执法行为的监督,适用本条例。
市、区(县)人民政府对设立在本行政区域内不属于本级人民政府管理的行政机关和组织的行政执法行为依法进行监督。
审计、监察、行政复议等专门监督活动,依照有关法律、法规的规定进行。
第三条 市、区(县)人民政府领导本行政区域的行政执法监督工作,对所属行政执法机关和下级人民政府的行政执法工作实施监督。
市人民政府所属行政执法机关对本系统下级行政执法机关的行政执法工作实施监督。
市、区(县)人民政府和市人民政府所属行政执法机关负责法制工作的机构是行政执法监督机构,在本机关的领导下承办行政执法监督的具体工作,并接受上级行政执法监督机构的业务指导。
第四条 行政执法监督遵循有错必纠,违法必究,保障法律、法规和规章正确实施的原则。
第五条 行政执法监督机关应当对下列事项进行监督:
(一)法律、法规、规章的执行情况;
(二)行政执法机关及其行政执法人员是否符合法定资格;
(三)行政执法行为是否合法、适当;
(四)行政执法机关是否正确履行法定职责;
(五)行政执法责任制、行政执法投诉制度的建立和执行情况;
(六)对行政管理相对人违法行为的调查处理情况;
(七)其他行政执法工作情况。
对规范性文件的审查监督,依照国家、省、市的有关专门规定进行。
第六条 行政执法监督采取以下方式:
(一)审查行政执法机关的行政执法主体资格;
(二)审查重大行政执法行为和事项;
(三)开展行政执法检查;
(四)听取行政执法工作报告;
(五)协调、裁决行政执法职责争议;
(六)评查行政执法案卷;
(七)立案查处行政执法投诉案件和违法或者不当的行政执法行为;
(八)法律、法规规定的应当监督的其他监督方式。
第七条 市、区(县)人民政府应当对其所属行政执法机关的行政执法主体资格进行审核、确认,并向社会公告。
第八条 行政执法人员应当参加市人民政府行政执法监督机构统一组织的行政执法资格培训;经考核合格且审查符合条件的,按规定取得《广东省人民政府行政执法证》后,方可从事行政执法活动。
法律、法规、规章对行政执法证件的名称、核发机关作出规定的,从其规定。
第九条 行政执法机关设立行政执法队伍的,应当依法报请市人民政府审批并予以公告;设立综合执法队伍的,应当依法报送有审批权的行政机关审批并予以公告。
未经公告的行政执法队伍不得从事行政执法活动。
第十条 行政执法机关应当将执法主体的名称、执法依据、执法权限、执法程序、执法责任、办事条件、办事时限等内容,通过政府公报、政府网站、政务公开栏等便于公众知晓的形式向社会公开,并报送本级人民政府行政执法监督机构备案。
第十一条 行政执法机关应当建立行政处罚、行政许可、行政强制等行政执法案卷,涉及行政管理相对人的监督检查记录、证据材料、执法文书等应当立卷归档。
行政执法监督机构应当定期组织行政执法案卷评查。
第十二条 市、区(县)人民政府所属行政执法监督机构,应当公开、公平、公正地对本级人民政府所属行政执法机关行政执法责任制的执行情况进行年度评议考核,并通过问卷调查、召开座谈会、定期走访等方式征求行政管理相对人的意见,评议考核结果应当向社会公开。
评议考核应当结合年度人事考评、行政效能监察进行。考核结果应当作为评价行政执法机关领导干部政绩和行政执法人员奖惩的重要依据。
行政执法机关应当在每年三月底前将上一年度行政执法责任制的执行情况,向本级人民政府所属行政执法监督机构报告。
第十三条 行政执法机关应当严格执行重大行政处罚、重大行政强制、重大行政许可、普遍性行政检查以及委托执法等重大行政执法行为和行政执法事项的备案制度。
行政执法机关实施下列重大行政执法行为和重大行政执法事项的,应当自作出实施决定之日起十五个工作日内,将法律文书副本和相关材料复印件报送本级人民政府所属行政执法监督机构备案:
(一)责令停产停业;
(二)吊销许可证或者执照;
(三)较大数额罚款;
(四)责令拆除对公民、法人和其他组织的生活、生产有重大影响的建筑物、构筑物;
(五)决定劳动教养和处以十五日以上行政拘留;
(六)依法可以要求听证或者在本行政区域影响较大需要举行听证的行政执法行为;
(七)委托执法等重大行政执法事项;
(八)法律、法规、规章规定应当报送备案的其他重大行政执法行为和重大行政执法事项。
上级行政执法机关已对重大行政处罚、重大行政强制、重大行政许可、普遍性行政检查以及委托执法等重大行政执法行为和行政执法事项的标准作出规定的,行政执法机关应当将上述标准报送本级人民政府所属行政执法监督机构备案。
行政执法机关决定实施普遍性的现场行政检查的,应当在实施前将实施方案报送本级人民政府所属行政执法监督机构备案。
第十四条 市、区(县)人民政府对报送备案的处罚决定,应当于收到备案报告之日起六十日内审查完毕。经审查发现有违反法律、法规、规章的,按《广东省各级人民政府行政执法监督条例》的规定处理。
第十五条 行政执法监督机构应当依法受理行政执法投诉,查处违法或者不当行政执法行为,作出行政执法督察建议或者提请行政执法监督机关作出行政执法督察决定。
行政执法监督机构应当公布行政执法投诉举报电话、通讯地址等,及时受理行政管理相对人的投诉、举报。
第十六条 行政执法机关之间在行政执法过程中发生职责争议的,应当向共同的上一级行政执法监督机关申请协调或者裁决。争议未经协调或者裁决之前,除关系公共安全或者公民人身安全外,行政执法机关不得单方作出处理决定。
第十七条 本市颁布的法规在施行一年后的三个月内,市、区(县)人民政府应当向本级人民代表大会常务委员会报告法规的实施情况。法规、规章的主要实施机关应当向本级人民政府报告法规、规章的实施情况。
第十八条 行政执法机关应当按规定将行政执法情况的统计结果和分析材料报送上一级行政执法监督机构。
第十九条 行政执法监督机关应当根据本行政区域、本系统的行政执法现状,组织开展专项行政执法监督检查活动。
对国家权力机关提出的或者上级行政机关交办的监督事项,行政执法监督机关应当组织开展专项行政执法监督检查并报告结果。
对司法机关提出的司法建议,行政执法监督机关可以组织开展专项行政执法监督检查并回复结果。
第二十条 对公民、法人和其他组织通过新闻媒体等途径反映的违法或者不当行政执法行为,行政执法监督机关应当及时调查、核实并依法作出处理。
第二十一条 行政执法监督机关应当加强对行政执法机关行政不作为情况的监督检查。
第二十二条 行政执法监督机构及其督察人员可以采取以下方式对被监督事项进行调查:
(一)调阅行政执法案卷和其他有关材料;
(二)询问行政执法机关有关人员、有关行政管理相对人和知情人;
(三)委托有关机构进行鉴定、评估、检测、勘验;
(四)组织开展论证、咨询和公开听证。
调查内容涉及国家秘密、商业秘密或者个人隐私的,应当依法履行保密义务。
行政执法监督机构及其督察人员对被监督事项进行调查时,与调查有关的行政执法机关及其工作人员应当予以配合。
第二十三条 行政执法监督机构及其督察人员对被监督事项进行调查时,督察人员与所承办的监督事项有利害关系或者其他可能影响公正履行职责关系的,应当回避。督察人员的回避由监督机构负责人决定,监督机构负责人的回避由监督机关负责人决定。
除对当场发现必须及时予以纠正的违法或者不当行政执法行为进行检查外,督察人员履行监督职责时不得少于两人,并应当出示行政执法督察证件。
第二十四条 市、区(县)人民政府可以根据需要聘请特邀行政执法监督员。特邀行政执法监督员在本级人民政府所属行政执法监督机构指导下从事行政执法监督工作。
督察人员和特邀行政执法监督员履行监督职责时,必须使用国务院、广东省人民政府统一规定的行政执法督察证件。国务院、广东省人民政府没有规定的,必须使用本级人民政府统一制发的行政执法督察证件。
第二十五条 行政执法机关及其工作人员执行本条例成绩突出的,由该行政执法机关的本级人民政府给予表彰、奖励。
第二十六条 行政执法监督机构在实施行政执法监督过程中,发现行政执法行为有下列情形之一的,可以依法制作《行政执法督察建议书》,通知被监督的单位限期纠正;逾期不纠正的,行政执法监督机构可以提出撤销、变更、确认违法或者责令重新作出行政执法行为的意见,报请行政执法监督机关作出行政执法督察决定:
(一)主要事实不清、证据不足;
(二)适用法律依据错误;
(三)违反法定程序;
(四)超越职权或者滥用职权;
(五)行政行为明显不当;
(六)法律、法规规定的其他情形。
《行政执法督察决定书》由行政执法监督机构负责送达,自送达之日起生效。被监督的单位收到《行政执法督察决定书》后,必须立即执行并将执行情况在三十个工作日内向行政执法监督机关报告。
第二十七条 行政执法监督机构在实施行政执法监督过程中,认为监督事项需要听证的,或者当事人要求听证且行政执法监督机构认为有必要的,应当举行听证。
第二十八条 行政执法机关违法或者不当的行政执法行为给公民、法人和其他组织造成人身损害或者财产损失的,行政执法监督机关应当督促其依法给予赔偿。
第二十九条 行政执法机关违法或者不当的行政执法行为严重侵害公共利益或者公民、法人和其他组织合法权益的,行政执法监督机关查处后应当依照有关规定将处理结果向社会公开。
第三十条 对依法应当由信访机关、行政复议机关、审计机关、监察机关或者其他监督机关处理的事项,行政执法监督机关应当及时移送有关机关处理,并书面告知当事人。
第三十一条 对于下级行政执法监督机关管辖的行政执法监督事项,上级行政执法监督机关认为有必要的,可以直接办理。
第三十二条 行政执法监督机构及其督察人员依法行使职权受法律保护。
妨碍督察人员依法执行职务的,依照《中华人民共和国治安管理处罚法》的有关规定处理;构成犯罪的,依法追究刑事责任。
第三十三条 行政执法监督机构在实施行政执法监督过程中,发现行政执法机关有下列情形之一的,应当责令其限期改正;逾期不改正的,可以给予通报批评,并有权建议有行政处分权的行政机关依法对该行政执法机关的有关领导和直接责任人员予以行政处分:
(一)不履行法定职责和行政行为超越、滥用法定职权或者违反法定程序的;
(二)不按规定执行行政执法主体资格审核公示制度和行政执法人员资格考核制度的;
(三)未取得行政执法主体资格从事行政执法活动,或者安排不具备行政执法资格的人员从事行政执法活动的;
(四)不按规定执行执法事项公开制度的;
(五)不按规定执行案卷评查制度的;
(六)不按规定执行行政执法责任制及其执行情况年度报告制度的;
(七)不按规定执行重大行政执法行为和行政执法事项备案制度的;
(八)不按规定执行行政执法投诉处理制度的;
(九)不按规定执行行政执法监督机关对行政执法职责争议的裁决决定的;
(十)不按规定执行本市颁布的法规、规章执行情况报告制度的;
(十一)不按规定执行行政执法统计制度的;
(十二)不配合行政执法监督机构调查工作,或者妨碍行政执法监督人员依法履行监督职责的;
(十三)拒绝执行行政执法督察决定,或者拒绝报告行政执法督察决定执行情况的。
第三十四条 行政执法监督机构在实施行政执法监督过程中,发现行政执法人员有下列行为之一的,可以暂扣其行政执法证件,并应当根据不同情况建议其所在行政执法机关给予批评教育、离岗培训、调离执法岗位的处理;依法应当给予行政处分的,建议有行政处分权的行政机关给予行政处分;构成犯罪的,移送司法机关依法追究刑事责任:
(一)不履行法定职责或者滥用职权、滥施处罚的;
(二)在行政执法工作中徇私枉法、索贿受贿,或者采取其他手段侵犯公民、法人和其他组织的合法权益的;
(三)对申诉、控告、检举者打击报复的;
(四)妨碍行政执法监督的;
(五)法律、法规规定的其他行为。
行政执法监督机构应当自暂扣行政执法证件之日起三个工作日内书面通知行政执法人员所在单位,并报市人民政府所属行政执法监督机构备案。市人民政府所属行政执法监督机构可以根据情况报请颁发行政执法证件的行政机关收缴行政执法证件。
暂扣行政执法证件的期限为十五日以上六个月以下。行政执法人员在被暂扣行政执法证件期间,不得从事行政执法活动。在被收缴行政执法证件之后,应当调离行政执法岗位。
第三十五条 有行政处分权的行政机关接到行政执法监督机构有关行政责任追究的建议后,应当立案调查,依法进行处理并将处理结果抄送行政执法监督机构。
第三十六条 行政执法机关对行政执法督察决定或者裁决决定不服的,可以自收到决定之日起十五个工作日内向作出决定的行政执法监督机关申请复查,作出决定的行政执法监督机关应当自收到复查申请之日起三十个工作日内作出复查决定;对复查决定仍不服的,可以自收到复查决定之日起三十个工作日内向上一级行政执法监督机关申请复核,上一级行政执法监督机关应当自收到复核申请之日起三十个工作日内作出复核决定。
市人民政府对复核申请作出决定为最终决定。复核期间,行政执法督察决定或者裁决决定不停止执行。
第三十七条 行政执法监督机构及其督察人员有下列情形之一的,由行政执法监督机关或者监察机关对有关领导和直接责任人员给予警告;情节严重的,报请发证机关收缴其行政执法监督证件,并依法给予行政处分;构成犯罪的,移送司法机关依法追究刑事责任:
(一)不履行或者不依法履行行政执法监督职责的;
(二)利用行政执法监督职权进行违法活动或者谋取私利的;
(三)有其他失职、渎职行为的。
第三十八条 本条例所称的行政执法机关,是指具有行政执法主体资格的行政机关。
本条例所称的行政执法监督机关,是指负责对所属行政执法机关和下级人民政府进行监督的市、区(县)人民政府,负责对本系统下级行政执法机关进行监督的市人民政府所属行政执法机关。
第三十九条 市人民政府可以依据本条例制定实施办法。
第四十条 本条例自2008年10月1日起施行。

PART II PROTECTION OF WAGES ON INSOLVENCY FUND BOARD

There is hereby established a board to be known as the Protection
of

The Board shall consist of a Chairman appointed under the Schedule

Payment
Subject to subsections (1B) and (2) where it appears

Review by Board
Any applicant aggrieved by any decision of the Commissioner
under
ion 16 may in writing--
request the Commissioner to give reasons for that decision; and
after being given reasons under paragraph (a),
request the
issioner to refer the application to the Board.
Upon receiving a request from an applicant under subsection (1)
(b),
Commissioner shall forward all documents relating to the
application
he Chairman of the Board.
The Board may confirm or vary any decision of the Commissioner
on an
ication referred to it under this section or may for those
purposes
ire the Commissioner to make further inquiries relating
to the
ication.
Additional power of Commissioner
Notwithstanding that in any particular case a petition referred
to in
ion 16 (1) (a) (i) or (b) has not been presented against an
employer,
Commissioner may, subject to subsection (2) of that section,
make an
ratia payment under that section in that case if in his opinion--

the employer employs less than 20 employees;
sufficient evidence exists to support the presentation of a
petition
hat case on the ground--
if the employer is a company, that he is unable to pay his debts;
or
if the employer is a person other than a company, that
he has

it is unreasonable or uneconomic to present a petition in that
case.
Where the Commissioner exercises his discretion under
subsection (1)
ake payment, he shall give notice in the Gazette stating that,
in his
ion, sufficient evidence exists to support the
presentation of a

if the employer is a company, that he is unable to pay his debts;
or
if the employer is a person other than a company, that
he has
itted an act of bankruptcy.
Nothing in subsection (2) shall require the Commissioner to give
more
one notice in respect of each employer.
No action shall lie against the Commissioner in respect of any
notice
n under subsection (2).
Verification of application
For the purpose of verifying any application under section 15,
or if
equired by the Board under section 17 (3), the Commissioner may
